Respected Sir,
I am
the State Secretary of National Federation of Telecom Contract Labours union,
Tamil Nadu Branch. On behalf of NFTCL
Tamil Nadu State branch I am conveying
our heartfelt wishes and greetings to you.
I am
submitting the few lines for
your kind notice about the pathetic condition of poor contract laborers working in BSNL. In
our BSNL Tamil Nadu region more than 10,000 contract workers are working for
the last 15 years. More than one lack labourers
are working all over India. Even though the work is in perennial
nature the work is given on contract basis only. Eventhough contract
system is going on in BSNL organization the Statutory rules are not followed
elsewhere. On our repeat complaint to
Dy.CLC ,RLC and ALC regarding the denial of statutory benefits they have
also issued many guidelines and
instructions regarding implementation of
Labour laws. But the instructions of the Labour department
is not at all obeyed by our BSNL Administration .
The Labour issues are as follows:
1) The Wages
of the contract laborers are not paid in fixed date. The wages are being paidas to the will and
pleasure of the contractors. As a
principal employer BSNL not at all intervenes in this matter. In most of the
places the wags are paid once in two/three months interval also.
2) Contract laborers are not provided with employment
card or Identity Card either by the Contractor
or by the BSNL management. Due to
this the laborers are facing problem during their duty time.
3) There
is no regular practice of paying Bonus every year to the contract laborers.
Every year we are raising the issue before the Labour Authorities for the
payment of Bonus. Even though the Labour
department authorities are directing the BSNL to ensure the payment of Bonus to
the Contract Labourers nothing is paid to the labourers and they are denied
bonus.
4) Wage
slips are not supplied to the Laborers
by the Contractors whichgives room for ambiguity. The Laborers are put in dark about their
wages and statutory benefits such as EPF
and ESI etc.. eligible for them.
5) The
Minimum Wages notified by the Labour
Ministry is also denied in BSNL. Laborer
are paid with meager amount as Wages to the will and pleasure of the Contractors and Principal employer.
6) In most
of the places the statutory benefits EPF are not paid. No UAN number is
allotted to them. No ESI facility is extended and the ESI card supplied to the
labourers.
7) In BSNL
the Contract Labourers are engaged in
various works as follows:
a) Cable
Jointing and trenching work
b) Watch
and ward duty with and without arms.
c) A/C
plant maintenance
d) House
keeping work
e) Sweeping
and Cleaning work
f) Computer
data entry work
g) Clerical
work
For the
above all categories Labourers are paid wages under “UNSKILLED”
category only. Even though the
Labour Ministry has categorized the workers andnotified their eligible wages
clearly, the BSNL management is paying
wages at par with Unskilled category only. This
is purely against the Labour ministry guidelines and also
against the verdict of Honble Supreme court of India.
Hence I
pray the honorable CLC to look into the above
matter and render justice to the poor Contract Labourers who are working
in BSNL years together without enjoying the Labour rights and benefits.
